The United States has a program, called Diversity Immigrant Visa Lottery (better known as the Green Card Lottery), making available each year by random selection 50,000 permanent residence visas (Green Cards) to people from around the world. The objective of the program is to issue Green Cards to individuals born in countries with historically low levels of immigration to the United States
   
Applicants for diversity visas are initially chosen through a random computer-generated lottery drawing.

Are there any changes for this year's lottery (DV2008)?

All DV-2008 lottery entries must be submitted electronically. No paper entries will be accepted. We are well prepared and have the right technology to submit lottery applications electronically. You still can submit your entry to us in paper format and we will convert it to an electronic format to be submitted to the U.S State Department.

The signature requirement on the DV entry has been eliminated and the registration period will start October 4, 2006 and ending at 12:00 pm on December 3, 2006.

 
 
 

What is a Green Card?

A Green Card is a Permanent Residence Visa of the U.S.A. A Green Card will give you legal right to work and live permanently in the United States. Green Card holders receive health, education, and several other benefits. If you win a Green Card, you can apply for U.S. Citizenship at a later time. The Green Card does not affect your present citizenship. You and your family could be lucky winners!

 
 
 
 
 

Who is eligible to apply for the lottery?

To enter, an applicant must be a native of an eligible country (see below), and must have either a high school education or its equivalent; OR two years of work experience within the past five years in an occupation requiring at least two years of training or experience (these requirements are explained in details below). If a person does not meet these requirements, he/she should Not submit an entry to the Visa Lottery program.

You are eligible wherever you are living. You do not have to speak English. You do not need to have relatives in the USA.

 
 
 
 
 

What are the requirements for education or work experience?

The law and regulations require that every applicant must have at least a high school education or its equivalent or , within the past five years, have two years of work experience in an occupation requiring at least two years training or experience. A "high school education or equivalent" is defined as successful completion of a twelve-year course of elementary and secondary education in the United States or successful completion in another country of a formal course of elementary and secondary education comparable to a high school education in the United States. Documentary proof of education or work experience should NOT be submitted with the lottery application, but must be presented to the consular officer at the time of immigrant visa interview.

 
 
 
 
 
Who is not eligible?

Persons born in the following countries are not eligible: BRAZIL,CANADA, CHINA (mainland-born), COLOMBIA, DOMINICAN REPUBLIC, EL SALVADOR, HAITI, INDIA, JAMAICA, MEXICO,  PAKISTAN, PHILIPPINES, POLAND, SOUTH KOREA, RUSSIA, UNITED KINGDOM (except Northern Ireland) and its dependent territories, and VIETNAM. Persons born in Hong Kong SAR, Macau SAR and Taiwan are eligible.

Any one not born in one of the above excluded countries may apply.

 
 
 
 
 
Must I re-apply every year for the lottery to be considered?

The law specifies there must be a separate application for each year's visa lottery. The fact that a person has registered for Visa Lotteries in the past has no effect on this year lottery (DV-2008). Each person who wishes to be included in DV-2008 must submit a new application.

 
 
 
 
 
HOW  IS  THE  TERM  "NATIVE"  DEFINED? Are there any bases upon which persons who have not been born in a qualifying country may be eligible to enter?

"Native" ordinarily means someone born within a particular country, regardless of the individual's current country of residence or nationality.

According to Section 202(b) of the Immigration and Nationality Act, if a person was born in an ineligible country but his/her spouse was born in an eligible country, such person can claim the spouse's country of birth rather than his/her own.  For example, a person born in an excluded country such as England may still apply if his or her spouse was born in a qualifying country.

Also, if a person was born in an ineligible country, but neither of his/her parents was born there or resided there at the time of the birth, such person may be able to claim nativity in one of the parents' country of birth. For example, if one of your parents was born in France and the other was born in Germany, and you were born in Canada while they were visiting Canada, but had not established residency; you could claim France or Germany as your qualifying country.

 
 
 
 
 
Why do certain countries not qualify for the diversity program?

Diversity visas are intended to provide an immigration opportunity for persons from countries other than the main source countries of immigration to the U.S. The law states that no diversity visas shall be provided for "high admission" countries, that is, countries from which during the previous five years there were more than 50,000 immigrants in the Family-Sponsored and Employment-Based visa categories. The list of countries which do not qualify is subject to change from one year to the next.
 
 
 
 
 
Is  each  applicant  limited to only one  application?

Yes, the law allows only one entry by or for each person during each registration period; applicants who submit more than one entry will be disqualified.  Applicants may be disqualified at time of registration or at the time of the visa interview if more than one entry is detected.  However, applicants may apply for the program each year.

 
 
 
 
 
May a husband and wife each submit a separate application?

Yes, a husband and a wife may each submit one entry. If either is selected, the other would be entitled to derivative status. Note: Husbands and wives may not sign for each other. Each applicant must sign his or her own entry. Submitting separate applications for you and your spouse double your chances of winning.

 
 
 
 
 
What Family Members Must I Include On My Entry For DV-2008?

On your entry you must list your spouse, that is husband or wife, and all unmarried children under 21 years of age. You must list your spouse even if you are currently separated from him/her. However, if you are legally divorced, you do not need to list your former spouse. You must list ALL your children who are unmarried and under the age of 21 years, whether they are your natural children, your spouse's children by a previous marriage, or children you have formally adopted in accordance with the laws of your country. List all children even if they no longer reside with you.

The fact that you have listed family members on your entry does not mean that they later must travel with you. They may choose to remain behind. However, if you include an eligible dependent on your visa application forms whom you failed to include on your original lottery entry, your case will be disqualified. (This only applies to persons who were dependents at the time the original application was submitted, not those acquired at a later date.) Your spouse may still submit a separate entry, even though he or she is listed on your entry, as long as both entries include details on all dependents in your family.

 
 
 
 
 
Is there a minimum age to apply for the lottery?

There is no minimum age to apply for the visa lottery. However, the requirement of a high school education or work experience for each principal applicant at the time of application will effectively disqualify most persons who are under age 18.
 
 
 
 
 
How would I know if I win?

Applicants will be selected at random by computer from among all qualified entries. Entries that do not have all required information will be rejected. Also, entries received before or after the announced dates will be disqualified  Only winners will be notified by mail at the address listed on their application. The notifications will be sent to the winners between April and July 2007, along with instructions on how to apply for an immigrant visa.

Persons not selected will NOT be notified.  U.S. embassies and consulates will not be able to provide a list of successful applicants.  Anyone who does NOT receive a letter will know that his/her application has not been selected.

All applicatns that use our service will be notified, Whether they win or not.

DV2008 visas will be issued between October 1, 2007 and September 30, 2008. Applicants must meet ALL eligibility requirements under U.S. law in order to be issued visas.

 
 
 
 
 
Can someone apply for the visa lottery if they are already registered in another visa category?

May registered applicants adjust their status with the INS?

Yes, provided they are otherwise eligible to adjust status under the terms of Section 245 of the INA, registered applicants who are physically present in the United States may apply to the Immigration and Naturalization Service (INS) for adjustment of status to permanent resident.
 
 
 
 
 
How many applicants will be registered?

There are 50,000 DV visas available, but more than that number of individuals will be selected.  Since it is likely that some of the first 50,000 persons who are registered will not pursue their cases to visa issuance
 
 
 
 
 
May persons who are in the U.S. apply?

Yes, an applicant may be in the U.S. or in another country, and the application may be mailed from the U.S. or from abroad.

 
 
 
 
 
Are green card lottery applicants specially entitled to apply for a waiver of any of the grounds of visa ineligibility?

No. Applicants are subject to all grounds of ineligibility specified in the immigration and nationality act and there are no special provisions for the waiver of any ground of visa ineligibility other than those Ordinarily provided in the act.

The U.S. State Department does not have a fee for Visa Lottery participation.
